A chieftain of the African Democratic Congress (ADC), Nkemakolam Ukandu, has filed a suit against the Chief Judge of the Federal High Court, Justice John Tsoho, over alleged disobedience of a court order concerning the transfer of a political case involving Nafiu Bala.
Ukandu, who serves as the ADC National Welfare Secretary, is seeking judicial intervention over what he described as the unlawful reassignment of the case to another judge despite an existing court directive.
In the suit, filed before the Federal High Court, the National Judicial Council (NJC) was listed as the first respondent, while Justice Tsoho and Justice Peter Lifu were joined as second and third respondents respectively.
The matter is centred on allegations that court administrative actions surrounding the transfer of the suit allegedly violated due process and a standing judicial order.
Although full details of the disputed order were not immediately made public, the plaintiff is asking the court to determine whether the Chief Judge acted within his constitutional powers in reassigning the case.
