Legal Expert Calls Kano Emirate Ruling “Strange,Confusing

”Professor Yadudu, a renowned legal expert, has labeled a recent court ruling on the Kano Emirate case as “strange and baffling.”

Speaking to Daily Trust, Yadudu criticized the judge for making contradictory pronouncements by assuming jurisdiction over the fundamental human rights aspect of the case while refusing jurisdiction on the validity of the Kano emirates law.

“This has muddled up the case, and it is very unbecoming of a judge who has now been elevated to the Court of Appeal,” Yadudu said, questioning the logic behind the ruling.

He highlighted the confusion of setting aside actions taken pursuant to a law without examining the validity of the law itself.

Yadudu also noted the inconsistency of the judge admitting to lacking jurisdiction but still setting aside the governor’s actions, suggesting that the ex-parte order should no longer be relevant as it is being challenged at the Appeal Court.

Mr. Napoleon Otache, convener of NCNLPIA, described the ruling as a victory for justice and the people of Kano State.

He urged Governor Abba Yusuf to apologize to Emir Ado Bayero for the humiliation caused by his dethronement.

Justice Abdullahi Liman of the Federal High Court, Kano, had overturned all actions taken by Governor Yusuf following the amendment of the Kano Emirate law by the State House of Assembly on May 23.

The judge criticized the governor’s actions despite a court order to maintain the status quo.In response, Attorney-General Haruna Dederi acknowledged the ruling as upholding the rule of law, viewing it as a reaffirmation of the validity of the Kano State House of Assembly’s legislation.

The court’s decision has sparked significant reactions, marking a crucial step toward justice and the preservation of traditional authority in Kano State.
