…Fresh Trouble as APC Chieftain drags Ganduje to Court, seeks removal as Party National Chairman

The former National Chairmanship Aspirant of the ruling All Progressives Congress (APC) Mohammad Saidu Etu has sought the removal of Dr. Abdullahi Umar Ganduje as National Chairman of the party.
Besides, Etu faulted insisted the power of the National Executive Council (NEC) of the APC that certified the appointment of former Governor of Kano state as the party National Chairman is ultra vires of the provision of constitution of the party and should not stand.
In the originating summon filed before a Federal High Court, Federal Capital Territory, Abuja division, the plaintiff through his counsel J. O. Obono-Obla Esq, formulated three critical issues for determination of the court while propelling immediate removal of Dr. Ganduje in office.
According to the written address, Etu urged the court to determine “whether the National Executive Committee (NEC) of the APC has the power to appoint Dr. Ganduje as National Chairman of the party, after the resignation of Senator Abdullahi Adamu.
Also raised secondly, whether the NEC of the party can override the decision of the National Convention of the APC taken on the 26th of March, 2022 on the election and tenur of former Chairman, Senator Adamu that runs up to 2026.
Subsequently put, on the third issue for court determination, borthered whether the National Convention of the APC is the final authority of the party during convention.
Etu who is calling for immediate return to the zoning system of the position of the party chairman insisted that Dr. Ganduje who is clearly coming from the North western zone is wrongly occupying the position reserved of candidate from the North Central zone.
The party Chieftain argued that NEC of the party had no modicum or scintilla of power to so appoint Dr. Ganduje as National Chairman when the party guiding principles clearly stipulated the procedure of nominating a replacement in any case of vacant into the position of the national chairman.
” The purported appointment of Dr. Ganduje is ultra vires the functions or powers vested on NEC in Article 13.3(a) (i-xvi) of the APC constitution stipulated the functions if NEC. After a clear check, NEC is not being conferred with the power of appointing the National Chairman of the party.
“The National Convention of the APC created by Article 11(1) of the party’s constitution is envisaged as the final authority of the party at the convention. Evidently so, the convention rectified Senate Abdullah Adamu as elected National Chairman through consensus for the tenur of four years, which is expected to lapse on or about March 2026Chairman”.
The plaintiff worried that APC NEC has violated the party constitution which provide a replacement of National Chairman, who is has not completed his tenure before exit, from the same zone that produced the exited National chairman.
Etu argued that Senator Adamu’s resignation should ordinarily pave ways for a now National Chairman from the North West who would be entrusted to complete the mandate of the former.
He claimed that Dr. Ganduje who is not from the North Central was not eligible to act in the absence of Senator Adamu, insisted that NEC who lack the power reserved of the NCC cannot foist the former Kano state governor on the party.
“We submit the contemplation of the farmers of APC constitution when they decided and inserted that where the position of National Chairman because vacant by a way of death, resign or removal, his replacement shall be the deputy National Chairman North/South who is from the same region as the National Chairman”. Etu insisted.
