The Attorney General of the Federation AGF has clarified that state governors lack the constitutional authority to suspend or dismiss local government chairpersons, even with the backing of state assemblies.

Responding to reporters’ questions regarding the Edo State Governor’s recent suspension of local government chairpersons through the State Assembly, the AGF emphasized the autonomy of local governments as enshrined in the Nigerian Constitution.

“Local government councils operate as a distinct tier of government under the law. Any attempt by governors to unilaterally suspend or dismiss their elected leadership undermines constitutional provisions,” he stated.

The AGF’s remarks come amidst growing legal debates over the limits of state governors’ powers in local government administration, particularly in states like Edo, where allegations of misconduct have sparked high-profile suspensions.

Observers have called for clarity on the matter, urging all parties to respect constitutional boundaries. The AGF hinted that the courts may soon decide on the legality of such actions to ensure compliance with Nigeria’s federal structure.
